This Privacy Policy explains how we process the personal data of visitors to the 3dmenu.pl website, of people who contact us through our forms and of representatives of hospitality venues interested in the 3dmenu.pl offer.

2. When do we process your data?
We process personal data in particular when you:
- use the contact form on the website,
- use the quote form or the pricing calculator,
- book a call or a demo,
- contact us by email, by phone or through other available channels,
- are the contact person for a restaurant, cafe, bar or other hospitality venue,
- use the 3dmenu.pl website,
- scan a QR code and browse an interactive 3D/AR menu provided by 3dmenu.pl.
3. What data may we process?
The scope of the data depends on how you contact us and on the purpose of processing.
In the case of the contact form we may process:
- first and last name,
- email address,
- phone number,
- the name of the venue or company,
- the content of the message,
- other data provided voluntarily in the form.
In the case of the quote form or the pricing calculator we may process:
- the first and last name of the contact person,
- email address,
- phone number,
- the name of the venue,
- the address of the venue,
- tax identification number (NIP),
- information needed to prepare a quote, e.g. the plan selected, the scope of the menu or the preferred form of cooperation.
In the case of booking a call we may process:
- first and last name,
- email address,
- phone number,
- the selected or preferred time of the call,
- information about the venue or the enquiry.
In the case of B2B clients and people representing hospitality venues we may process:
- the first and last name of the contact person,
- email address,
- phone number,
- the name of the venue,
- the address of the venue,
- tax identification number (NIP),
- data necessary to prepare an offer, conclude an agreement, deliver the service and handle settlements.
In the case of people visiting 3dmenu.pl or browsing a menu after scanning a QR code, we may also process technical and analytical data such as:
- IP address,
- device type,
- browser type,
- operating system,
- approximate location derived from technical data,
- information on how the site is used,
- analytical events, e.g. subpages visited, clicks, time spent on the site.
As a rule, a person browsing the 3D/AR menu after scanning a QR code does not give us any personal data. In that case only technical and analytical data connected with use of the site may be processed.
4. Purposes and legal bases of processing
We process your personal data for the following purposes:
a) Handling enquiries and contact
We process the data provided in the contact form, in an email or during a phone call in order to answer your question, prepare a reply or continue the conversation.

Article 6(1)(f) GDPR - the legitimate interest of the controller in handling correspondence and contact with people interested in the offer.
If the contact is aimed at concluding an agreement, the basis may also be:
Article 6(1)(b) GDPR - steps taken prior to entering into a contract.
b) Preparing a quote or an offer
If you use the quote form or the calculator, or ask us to prepare an offer, we process the data needed to analyse your enquiry and present a proposal for cooperation.

c) Booking a call or a demo
If you book a call, a consultation or a demo of the 3dmenu.pl solution, we process the data needed to agree a time and hold the meeting.

Article 6(1)(f) GDPR - the legitimate interest of the controller in organising contact with a prospective client.
d) Delivering cooperation with B2B clients
If cooperation with a hospitality venue goes ahead, we process the data of contact persons and the company data needed to deliver the service, keep in working contact, handle the rollout, prepare materials and settle payments.

Article 6(1)(b) GDPR - performance of a contract or steps taken prior to entering into it,
Article 6(1)(f) GDPR - the legitimate interest of the controller in contacting people who represent a business client.
e) Settlements, invoices and legal obligations
We process the data necessary to issue accounting documents, handle settlements and meet obligations arising from the law.
Legal basis:
Article 6(1)(c) GDPR - a legal obligation to which the controller is subject.
f) Pursuing or defending against claims
We may process data in order to establish, pursue or defend against possible claims.
Legal basis:
Article 6(1)(f) GDPR - the legitimate interest of the controller in protecting its rights.
g) Site analytics and improving the service
We use analytics tools that help us see how users move around the website, which sections are visited most often and how we can improve the site and our offer.
For this purpose we use:
- Google Analytics 4,
- Google Tag Manager,
- Microsoft Clarity.
Microsoft Clarity may be used, among other things, to analyse user behaviour on the site, to create heatmaps and to record sessions, in a way that serves to improve the usability of the site.
Legal basis:
Article 6(1)(a) GDPR - the user's consent, where data is processed by means of analytical cookies or similar technologies that require consent.
You can withdraw your consent at any time by changing the cookie settings on the site or the settings of your browser.
5. Source of the data
We obtain data primarily directly from you, e.g. when you fill in a form, contact us by email or phone, or book a call.
In the case of B2B contacts we may also process data of people representing hospitality venues obtained from publicly available sources, such as the venue's website, a public company profile, a Google business listing or social media, solely for the purpose of business contact and presenting our offer.
6. Providing data is voluntary
Providing data is voluntary, but it may be necessary in order to handle your enquiry, prepare a quote, book a call, present an offer or deliver the cooperation.
If you do not provide the required data, we may not be able to answer your enquiry or prepare an offer.
7. Recipients of the data
Your data may be passed to entities that support us in running the site, handling contact, analytics, accounting or delivering services.
These may in particular be:
- IT service providers,
- providers of hosting and technical infrastructure,
- email providers,
- providers of analytics tools, including Google and Microsoft,
- providers of form handling tools,
- an accounting office or entities supporting settlements,
- entities providing legal, advisory or technical services,
- public authorities, where the obligation to disclose data arises from the law.
We do not sell your personal data.
8. Transfers of data outside the European Economic Area
In connection with the use of tools such as Google Analytics 4, Google Tag Manager and Microsoft Clarity, data may be transferred outside the European Economic Area, in particular to the United States.
In such cases the transfer takes place with the appropriate safeguards provided for by the GDPR, such as adequacy decisions, standard contractual clauses or other legal mechanisms applied by the service providers.
9. How long do we keep the data?
We keep data only for as long as it is needed for the given purpose.
We apply the following retention periods:
- contact form data - up to 12 months from the last contact, unless cooperation begins earlier or another basis for further retention arises,
- quote form or calculator data - up to 12 months from preparing the offer or from the last contact,
- data connected with booking a call - up to 12 months from the last contact,
- B2B client data - for the duration of the cooperation and then for the period needed to secure possible claims,
- accounting and tax data - for the period required by law,
- data processed on the basis of consent - until consent is withdrawn,
- analytical data - in line with the settings of the given analytics tool or until consent for analytical cookies is withdrawn.
10. Your rights
In connection with the processing of personal data you have the following rights:
- the right of access to your data,
- the right to receive a copy of your data,
- the right to rectification of your data,
- the right to erasure of your data,
- the right to restriction of processing,
- the right to data portability,
- the right to object to the processing of your data,
- the right to withdraw consent, where data is processed on the basis of consent.
Withdrawing consent does not affect the lawfulness of the processing carried out before it was withdrawn.

We do not use advertising or remarketing tools on the site, such as Meta Pixel or Google Ads, unless this is expressly stated in a future update of the Privacy Policy.

This Privacy Policy was drawn up in Polish. Versions in other languages are provided for information only - in the event of any discrepancy, the Polish version is binding.
